By present application, the applicant is seeking to condone the delay of 164 days in filing appeal. Non applicant no.2-victim is already served. However, none appears on her behalf.

Learned counsel for the applicant submits that the delay has occurred because it took some time for the applicant to seek legal aid. The applicant is in jail. Therefore, has restrictions of communication and could not give instructions in time. In view of above and for the reasons stated in the application, the application is allowed. Delay is condoned. The application is disposed of.
