DATED : MARCH 15, 2016.

Heard Shri U.P.Dable, advocate for the applicant and Shri N.S.Khubalkar, A.P.P. for the non-applicant. The applicant is arrested on 2nd September, 2015 in the crime registered against him for the offence punishable under Section 302 of the Indian Penal Code.

The accusations against the applicant are that he has strangulated his wife to death.

Charge-sheet is filed. Though the application is opposed by the learned A.P.P. on the ground that there are extra-judicial confession made by the applicant and there is possibility that the applicant may pressurize the witnesses, considering the facts on record and as the non-applicant has not been able to show that the custody of the applicant is required for further investigation, in my view, the applicant is entitled to be released on bail.

Hence, the following order :

2 ba80.16 i) The applicant, having been arrested in Crime No. 59 of 2015 registered by the non-applicant, he be released on bail on furnishing P.R. Bond in the sum of Rs.Twenty Five Thousand with two solvent sureties in the like amount.
