Heard Advocate Shri Khushalani for the applicant.
He has submitted that there is no other evidence against the present applicant except the statement under section 27 of co-accused.
Learned APP Ms. Udeshi pointed out statement of witness Rajvishnusingh Verma and submitted that he saw both the accused entering in the house of the victim. He heard the conversation between the accused. There is sufficient evidence against the applicant. Hence, application is liable to be rejected.
From the perusal of statement of Rajvishnusingh Verma, it appears that both the accused went to his medical shop to purchase tablet, they were discussing/saying that they wanted to have sexual intercourse with the deceased. Again they came to the premises of medical store of this
ba115.19.O.odt witnesses at about 12:00 a.m. in the night this witness keep watch on both the accused he followed them he saw both the accused entering in the house of victim. Early in the morning of 28.06.2018, he came to know about the death of victim Aruna Dongre. There is not only confessional statement of accused but also statement of this witness show the involvement of present applicant along with coaccused. Hence, he is not entitled for bail. Application is rejected.
