Claim filed on behalf of the applicant, in respect of death of one Baburao, the nephew of the deceased, was dismissed by learned Member of the Railway Claims Tribunal, Nagpur. Since the appeal was barred by limitation, he has filed the present application for condonation of delay. Delay is of 175.

Heard learned counsel Shri R.G.Bagul for the applicant.

Though the application is opposed by learned counsel Shri N.P.Lambat for the non-applicant, there is no reply to the application which is on affidavit. 4.

After having gone through contents of the application and after having heard learned counsel for parties, I am of view that the applicant has satisfactorily .....2/-

Hence, the civil application is allowed. The delay is condoned. Office is directed to register the appeal. The civil application stands disposed of accordingly.
