DATE : November 02, 2018 Prayer has been made to condone the delay in filing the Second Appeal. It is stated that the original plaintiff expired after the judgment of the appellate Court. He was aged about 82 years at that time. The legal heirs were not aware about pendency of the proceedings. On that count after getting necessary information and collecting relevant documents, the appeal came to be filed. The application is accompanied with various documents indicating the treatment that was being undertaken by the original plaintiff. The application is opposed by the learned Assistant Government Pleader for the non-applicants. However, on perusing the application and accompanying documents it is found that the delay is not caused deliberately. Same is therefore condoned.

Civil Application is disposed of.
