The applicants/appellants seeking for condonation of delay of 9745 days caused in filing the First Appeal for enhancement of compensation amount. It is brought to my notice that, the real brother of the appellant has similarly filed First Appeal No. 3263 of 2017 in which this Court has condoned the delay of 9760 days (in Civil Application (CAF) No. 2772) on condition that the applicant will not claim interest on the enhanced amount of compensation.

In this matter also, the appellant submitted that, he will not claim interest on the enhanced amount of compensation, if granted, for the period of delay. In view of that, the delay is condoned and the Civil Application stands disposed accordingly.

2 CAF2269.19 FIRST APPEAL ST. NO. 2460 OF 2017 Issue notice for final disposal of the matter, returnable on 17.12.2019.
