The applicant is apprehending arrest in Crime 5/2021 registered with Malegaon Police Station for the offences punishable under Sections 376(2)(n) and 506 of the Indian Penal Code.

The crime is registered on the basis of report lodged by Ms. 'M' that the applicant, who was the conductor of the bus in which she was travelling, raped her in the moving bus.

Learned Additional Public Prosecutor Mr. Mehroz Pathan has fairly pointed out that in the statement recorded under Section 164 of the Code of Criminal Procedure, 1973, Ms. 'M' has stated that she has no grievance and that she lodged the complaint out of anger.

In the event of arrest of the applicant in Crime 5/2021 registered with Malegaon Police Station, Tahsil Malegaon, District Washim for the offences punishable under Sections 376(2)(n) and 506 of the Indian Penal Code, the applicant shall be released on furnishing PR bond of 20,000/- (Rupees Twenty Thousand).

The applicant shall attend the concerned police station as and when directed, till the filing of the chargesheet, if at all. 7.

The applicant shall not make any attempt to influence the course of investigation.

The application is disposed of.
