Shri A.B. Patil, the learned Counsel for the appellant has invited my attention to the common judgment and order, dated 26/07/2012, passed by this Court in First Appeal No.1263/2009 and other connected matters. The appeals filed by the V.I.D.C. have been dismissed and the counter claims filed by the claimants in those first appeals have been allowed. In the present matter, there is no counter claim filed by the respondent-claimant. The controversy is covered by the aforesaid decision of this Court. For the reasons stated in the aforesaid decision, the present first appeal is dismissed with no order as to costs. JUDGE *sandesh
