The present application is filed for condonation of delay in filing first appeal.

Though the respondents are served, only respondent nos. 1 to 3 have appeared through their Advocate Shri Sawan Alaspurkar. 3.

None for respondent nos. 4 and 5.

There is delay of 691 days in filing the appeal. The claimants/respondents have no objection to condone the delay. 5.

For the reasons stated in the application, the delay for filing First Appeal is hereby condoned.

The Registry is directed to restore the First Appeal.

25. CAF 452.2021 & CAF 671.2022 in FA St 2446.2021 CIVIL APPLICATION (CAF) NO. 671 OF 2022 The present application is filed by the respondent/claimant nos. 1 to 3 for withdrawal of amount.

For the reasons stated in the application, the respondent/claimant nos. 1 to 3 are permitted to withdraw 50% amount.

The respondent no. 2 being minor through natural guardian - applicant no. 1 is allowed to withdraw the amount on his behalf. The 50% amount is permitted to withdraw subject to the usual undertaking that if the appellant succeed in the appeal, the amount will be refunded as per final order in First Appeal. (Smt. M.S.
