The challenge raised in the present writ petition is to the common order below Exhs.1, 13 and 16 dated 01.03.2021 disposing of the applications Exhs.13 and 16 and issuing notice to Bapurao Doma Moon and Shri Dharmapal Bapurao Moon on court's own motion. 2.

Admittedly, the present petition came to be filed after about three years from the date of passing of the impugned order. There are no explanation given as regards the delay and latches. The only explanation which is given is that, the petitioner was not knowing the consequences of the impugned order. Such excuse cannot be accepted particularly when the petitioner was represented by a lawyer before the learned trial Court.

In the circumstances, for not showing any sufficient cause for delay in filing the writ petition on the ground of delay and latches, the writ petition is dismissed. JUDGE C.L. Dhakate
