The applicant has filed this application to transfer the divorce petition which is filed by the non-applicant before the Civil Judge Senior Division, Basmat, District-Hingoli to Civil Judge Senior Division, & J.M.F.C, Pusad, Dist. Yavatmal.

Learned counsel appearing for the applicant has stated that the applicant is staying at Pusad and two proceedings are already pending before Civil Judge Senior Division & J.M.F.C, Pusad, Dist. Yavatmal, under the provisions of Domestic Violence Act and Maintenance Petition, he is attending the said proceedings, hence, prayed to transfer the matter which is pending before the Civil Prity

Though, the applicant is served through private mode and affidavit is filed by applicant along with the track consent. It shows that, the nonapplicant is served, the proceeding before the Civil Judge Senior Division, Basmat, Dist. Hingoli is stayed as the applicant is staying at Yavatmal and two proceedings are pending before the Civil Judge, Senior Division & J.M.F.C, Pusad, Dist. Yavatmal and the non-applicant is appearing in said Court, if the matter is transferred and same date is taken by the non-applicant, it will be convenient for both of them to attend the Court.

Hence, the Miscellaneous Civil Application is allowed. The Hindu Marriage Petition No.34/2024, pending before the Civil Judge Senior Division, Basmat, District-Hingoli is transferred to the file of Civil Judge Senior Division & J.M.F.C, Pusad, Dist. Yavatmal.
