Heard Advocate Shri P.K.Dhomne with learned counsel Shri R.M.Patwardhan for the appellant and learned Additional Public Prosecutor Shri P.S.Tembhare for the respondent/State.

The present appeal was filed in year 2007 challenging judgment and order of conviction dated 17.2.2007 passed by learned 2nd Ad hoc Additional Sessions Judge, Wardha in Sessions Trial No.193/2006 whereby the appellant was convicted for offences under Sections 304-A and 201 of the Indian Penal Code.

On 11.4.2007, the present appeal was admitted and the appellant was released on bail.

After paper-book was prepared and when the appeal was listed for its final hearing on 19.7.2019, learned .....2/-

apeal97.07 9 counsel Shri R.M.Patwardhan for the appellant, placed a photocopy of death certificate of the appellant which was taken on record. Learned Additional Public Prosecutor Shri P.S.Tembhare for the State, submitted that time be granted to verify the fact. Accordingly, the time was granted. 5.

Today, when the present appeal was taken up for its final hearing, learned Additional Public Prosecutor Shri P.S.Tembhare, submitted that he has instructions to make a statement on behalf of the State that appellant-Shalik Bisan Masram has expired on 28.7.2016. He also invited my attention to a report submitted by Police Station Officer of Police Station Seloo with Registry of this Court in that behalf.

In view of the fact that appellant-Shalik Bisan Masram has expired, the present criminal appeal is disposed of as abated.
