Heard learned counsel for the rival parties.

Learned counsel for the applicants submits that para 2 of the impugned order shows that the learned Appellate Court has closed its mind which may affect final disposal of the pending appeal before it. Hence I make the following order:- The observations made by the learned Appellate

Court in Paras 2 and 3 of its order shall not come in the way while deciding the Criminal Appeal pending before him. The appeal shall be decided as expeditiously as possible.

Criminal Application is disposed of.
