When this Court has expressed its opinion to dismiss the present application, Mr. Tiwari, learned counsel for the applicant, submits that he wishes to withdraw the present application.

At this stage, it is pointed out to this Court by the learned counsel for the applicant that charge-sheet is filed on 28.08.2017 but till today the case is not committed to the Court of Sessions.

Mr. Rode, A.P.P. for the non applicant-State is directed to take necessary instructions in that behalf from the investigating officer and also from the Police Prosecutor of the concerned Court.
