Heard the learned counsel for the parties.

The Petitioner, who is a Member of the Walmiki Matshyapalan Sahakari Sanstha Ltd., Mudaza (BU), Tahsil and District Gadchiroli, interested in participating in the election to the District Central Cooperative Bank Ltd. at Gadchiroli, has filed this petition challenging the notice dated 11 January 2021 issued by the State Cooperative Election Commission, State of Maharashtra. The Petitioner has also sought a direction to postpone the election. 3.

It is the contention of the Petitioner that the final voters' list has not been properly published as mandated by the order passed by this Court in Writ Petition No.942 of 2020 and KHUNTE

2 / 2 932-WP 856.2021 the mandate of the earlier order passed by the Election Commission on 30 December 2020 is also not complied with. 4.

The learned Assistant Government Pleader states that the final voters' list was published on 4 January 2021. The impugned order which is issued by the State Cooperative Election Commission asserts that the final voters' list was published on 4 January 2021. Once the final voters' list was published on 4 January 2021 and the same was not in order according to the Petitioner, he ought to have approached this Court early, instead the Petitioner has filed this petition on 5 February 2021. 5.

The Learned Assistant Government Pleader points out that the election was held as scheduled and a candidate has been elected unopposed.

In view of this position, we do not find that interference in writ jurisdiction is required.
