The applicant is apprehending arrest in Crime 566/2020 registered with Bhadravati Police Station, Tah. and District Chandrapur for the offences punishable under Sections 65(a) and 83 of the Maharashtra Prohibition Act.

The applicant contends that he hails from reputed family and that he has no nexus whatsoever with the seizure of country liquor bottles from co-accused and that the applicant is arrested on the basis of disclosure made by the accused.

The applicant is facing as many as 8 similar prosecutions. Two offences are registered with Police Station, Bhadravati, five offences are registered with Police Station, Ghughus and one offence is registered with Police Station, Ramnagar. According to the prosecution, the applicant has played an extremely
2 aba 71.2021 significant role in the crime taking advantage of the fact that he is working as manager with the country liquor shop. According to the prosecution, the applicant is a repeat offender and if he is protected, it would be difficult to take the investigation to the logical end. 5.
In my considered view, there is more than ample material on record to link the applicant with the crime. The applicant has adverse antecedents. The crime is serious since the prohibition policy which is introduced in the district concerned, is likely to be rendered ineffective, if not already rendered ineffective by the activities of illegal sale of liquor. The applicant has persisted in indulging in such activities and no discretion can be exercised in his favour.
