Shri Naik, learned counsel for the applicant, states that the applicant is protected by orders passed on his anticipatory bail application. If charge-sheet is filed, he should be given liberty to move appropriate application seeking discharge and that application should be considered on its own merits.
Learned Additional Public Prosecutor as also Advocate Wakode appearing for respondent no.2 - original complainant submits that after charge-sheet is filed, as per law, the applicant can alway move appropriate application.
In this situation, with liberty to applicant to move appropriate application in case charge-sheet is filed and keeping all rival contentions open, we dispose of criminal application. No costs.
