The applicant is apprehending his arrest in connection with Crime No. 242/2017 registered with Police Station, Malkapur (Rural), Dist. Buldana for an offence punishable under Sections 302, 498-A read with Section 34 of the Indian Penal Code.

The applicant is cousin father in law of the deceased Rekha. From the reply and other investigation papers, it is crystal clear that she was done to death by her husband. According to the reply, at the time of incident, the applicant was standing outside the house and prior to some days, he gave a slap on the cheek of the deceased. With such type of allegation against the applicant, the applicant deserves to be released on anticipatory bail. 4.
In view of above, following order is passed.

ORDER
(i) Criminal Application No.70/2018 is allowed.
(ii) In the event of arrest in connection with Crime No.242/2017 registered with Police Station, Malkapur (Rural), Dist. Buldana for an offence punishable under Sections 302, 498-A read with Section 34 of the Indian Penal Code, applicant-Pralhad Tulshiram Tayde, be released on bail on he executing P.R. Bond in the sum of Rs.25,000/- with two solvent sureties in the like amount. (iii) The applicant shall attend Police Station, Malkapur (Rural) once in a month i.e. on third Saturday of every month till the filing of the charge-sheet. (iv) The applicant shall remain with the investigating officer from 02.00 p.m. to 05.00 p.m.
(v) The observations made in the order are prima facie in nature and made only for the limited purpose of deciding the present application for bail. The learned trial Judge shall not get influenced by any of the observations made in this order.
