This application is for condonation of delay. 2.
The respondent No.1 though served, none appeared. Learned AGP Ms. Udeshi, appears for respondent Nos.2 and 3 who has no objection for condonation of delay.

As per contention of the appellant, the appellant is a statutory body who has to obtain the necessary approvals before preferring the appeal, wherein the time was consumed and, therefore, the delay of 138 days is caused in preferring the appeal. Considering the reasons mentioned in the application, it appears that delay is caused due to the unavoidable circumstances which is satisfactory reason hence, delay deserves to be condoned. In view of that,
(2) 24.caf.577.2021 civil application is allowed. Delay of 138 days is condoned.

By this application, the appellant is seeking stay to the effect, operation, implementation and execution of the impugned judgment and award dated 21.06.2019 passed by the Joint Civil Judge Senior Division, Yavatmal in Land Acquisition Case No.522/2011.

Learned Advocate Ms. Ira Khisti for the appellant submitted that principal amount is already deposited before the Reference Court.

On depositing the interest amount along with the statutory benefit within ten weeks, the effect,
