The applicant is arrested on the allegations that he has assisted co-accused Vishwajeet and Ravi in running away from the spot of incident, knowing fully well that co-accused Vishwajeet and Ravi have committed murder.

Shri P.S. Girdekar, learned Advocate has submitted that the applicant is studying in 12th Standard in Science faculty. It is submitted that the applicant has not been involved in any crime, earlier. It is further submitted that the allegations made against the applicant are not correct.

Considering the facts on the record and as the non-applicant has not been able to show that custody of

2 ba84.16 the applicant is required for further investigation, in my view, the applicant is entitled for bail.

Hence, the following order :

i) The applicant having been arrested in connection with Crime No.38/2016 registered by the nonapplicant, the applicant be released on bail, on furnishing P.R. Bond in the sum of Rs.10,000/- and two solvent sureties in the like amount.

ii) On filing the charge-sheet, the applicant shall attend the sessions trial on every date unless he is granted exemption by the Sessions Court. In default on the part of the applicant to attend any date before Sessions Court without seeking exemption from the Sessions Court, this order shall stand recalled.

iii) The application is allowed in the above terms. In the circumstances, the parties to bear their own costs.
