20th February, 2017 Perused the contents of the application. The total amount deposited by the appellant is Rs.5,97,481-00. It is submitted that the order dated 19th December, 2016 was passed after considering the order passed on Civil Application No. 3850 of 2016, by which fifty per cent amount was permitted to be withdrawn on filing undertaking and fifty per cent amount was permitted to be withdrawn on furnishing solvent surety.

In view of aforesaid, it is clarified that the

respondent no.1 is permitted to withdraw fifty per cent of the deposited amount on filing an undertaking and remaining fifty per cent amount on furnishing solvent surety.
