The appellant is the original plaintiff. Respondents are the original defendants. The appeal arises out of the suit for specific performance of contract. An agreement is stated to be entered into by the plaintiff and the defendants as purchase and sellers respectively.

The defendant No.1 has expired and the appeal is abated against him. Since the suit is for specific performance of contract and the appeal abates in its entirety, reserving liberty to the appellant to take steps for setting aside abatement and bringing legal representatives of respondent No.1 on record, the second appeal is disposed of as abated. No order as to costs.
