By this application, the applicant is seeking relaxation of the condition which is imposed by this Court while releasing the applicant on bail by order dated 12/03/2018.

By this order the applicant was directed that he shall not go abroad except upon leave obtained for that purpose from the trial Court and the applicant shall regularly attend the trial before the Sessions Court and shall co-operate with the Sessions Court in expeditious disposal of the case as well as he was directed to deposit his passport, if he has the passport, with the Investigating Officer within seven days of the passing of that order. 3.

Now, this application filed for relaxation of the condition that the passport be returned to him for renewal purpose as the validity period is already over and

904.appa.235.25.odt condition No.(ii) that the applicant shall not go abroad except upon leave obtained for that purpose from the trial Court. As far as the condition in respect of the leaving India and going abroad is concerned which cannot be considered as still the trial is pending against the present applicant, therefore, that condition will remain as it is. As far as the condition that surrendering of passport is concerned which can be taken into consideration as the validity period of the said passport is over. 4.

In view of that, the application is partly allowed.

The condition that the applicant shall deposit as to his passport is modified to the extent that the Investigating Officer shall return the said passport to the applicant for renewal purpose. On renewal of the passport the applicant shall again deposit the passport with the Investigating Officer.

The application is disposed of.
