The order impugned is appealable under Section 6 of the Maharashtra Restoration of Land to Scheduled Tribes Act, 1974 (Act).

However, since there is no Presiding Officer available at Maharashtra Revenue Tribunal (MRT), Nagpur due to the retirement of then Presiding Officer, the petitioner will have to prefer the appeal at Pune, MRT to which the charge is assigned.

In this view of the matter, the petitioner is permitted to withdraw the petition with liberty to prefer appeal.

The possession of the petitioner qua the agricultural land in question shall be protected for fifteen days to enable the petitioner to prefer the appeal.
