DATE : 01-03-2021 The applicant is apprehending arrest in Crime 36/2021 registered with Police Station Dahihanda, Akola for offences punishable under Sections 420, 466, 468, 471 read with Section 34 of the Indian Penal Code. 2.

The only role which is attributed to the applicant is that her husband, since deceased, was the beneficiary of the fraud committed, with the assistance of the Revenue Officials and that he (husband of the applicant) transferred the agricultural field in question in her favour. No role is attributed to the applicant lady in creating the false and fabricated revenue record. The allegation is that the agricultural field is owned by the complainant having inherited the same from his deceased grand-father and deceased father. The complainant lodged report that deceased husband of the applicant Kisan Tade acting in collusion with the Talathi and Revenue Officer took fraudulent mutation entry purporting to extinguish the complainant's ownership

2 12-aba-76-21 and purporting to confer the ownership on Kisan Tade. 3.

Since the only role attributed to the applicant is that her deceased husband Kisan Tade transferred the agricultural field in her favour, the pre-arrest protection granted vide order dated 15th February, 2021 is made absolute subject to only modification that the applicant shall attend the concerned Police Station till the filing of the chargesheet as and when required.

The Criminal Application is disposed of.
