After hearing the learned Counsel for the applicant to some extent and after going through the investigation papers it reveals that 8 years girl is subjected for sexual assault allegedly by the applicant. The medical report is also on record which substantiate the said contention, therefore, I have shown my disinclination to grant bail to the present applicant.

In view of that, learned Counsel for the applicant seeks permission to withdraw the application with liberty to file afresh after recording of the evidence of material witnesses.

Permission is granted to withdraw the application.

The application is disposed of as withdrawn with liberty as prayed for.
