Heard Shri R.R. Vyas, learned counsel for the applicant and Shri N.S. Rao, learned APP for respondent Nos. 1 to 4.

Criminal Writ Petition No. 951 of 2015 was disposed of after hearing both of them on 29.11.2016 under the impression that the Divisional Complaints Authority functioning under the Maharashtra Police (Amendment Act and Continuance) Ordinance 2014, was available to examine the grievance.

Today, learned APP states that the said Authority has still not started functioning.

In this situation, we recall order dated 29.11.2016 and restore Writ Petition No. 951 of 2015 back to file.
