Dated : 3 rd March, 2015 Both the authorities below have disqualified the petitioner under Section 14(1)(h) of the Bombay Village Panchayats Act, 1958 on the ground that the petitioner has failed to pay the tax due to the Panchayat within a period of three months from the date on which the the amount of such tax was demanded and the bill for the purpose was duly served upon him. The authorities below have recorded the finding that the bill of demand was issued on 11-8-2011, it was received by the petitioner on 25-9-2011, the amount was deposited on 28-2-2012, and, therefore, the petitioner has incurred the disqualification.

It is the contention that the signature on the receipt of this bill for demand on 25-9-2011 is forged and fabricated. The petitioner was in arrears of tax for the year 2011-12. The findings recorded by the authorities below are based upon the evidence on record, which do not call for interference.

The petition is dismissed.
