The learned counsel appearing for appellant and the respondents jointly submit that the controversy in the present appeal stands squarely covered by the judgment dated 07.01.2025 passed by this Court in First Appeal No.132/2017. They submit that the present appeal can be disposed of by granting compensation at the same rate awarded by this Court in the said appeal.

Accepting the submission, the appeal stands disposed of by holding that respondent No.1 is entitled to receive compensation for the acquired land @ Rs.275 per sq. ft. The statutory benefit be calculated and paid as per enhancement granted. 3.

In view of the aforesaid, the amount deposited by the appellant with this Court along with accrued interest be disbursed to the respondent No.1/claimant without making any deduction. The appellant is directed to deposit balance amount as per the present judgment within a period of six months from today.
