Heard learned counsel for the rival parties.

We have perused the evidence. We find the prosecution case is based purely on circumstantial evidence.

We have seen the circumstances enumerated by the trial Court in paragraph No.21 of its judgment. Prima facie, we are satisfied that they are not enough. Hence, we make the following order :

ORDER

i) Criminal Application (APPA) No.102 of 2015 is allowed.

ii) The applicant / accused be released on bail upon his furnishing P.R. Bond in the sum of Rs.10,000/- .....2/-

appa102.15 with one surety in the like amount.

iii) The applicant / accused shall report to the concerned Police Station on last Sunday of every month between 11:00 am and 04:00 pm.

iv) The application is disposed of accordingly. JUDGE JUDGE !! BRW !!
