We set aside the order impugned dated 26.10.2023 and direct the respondent-Committee to decide the tribe claim of the petitioner on its own merit instead of keeping the matter in abeyance. 3.

The aforesaid order is necessary having regard to the fact that at the relevant time when the proposal was received, it was bounden duty of the Committee to decide the tribe claim of the petitioner within a reasonable period of six weeks, which they failed to discharge. Even otherwise there are no powers to pass such order which is impugned in the petition.

That being so, we permit the petitioner to appear before the respondent-Committee on 10.03.2025.

The Committee to decide the tribe claim of the petitioner within a period of six months thereafter.

The petition stands allowed in above terms.
