The applicant is apprehending arrest in Crime 619/2020 registered with Police Station, Awdhuthwadi, District Yavatmal for the offences punishable under Sections 498-A, 323, 504 and 506 read with Section 34 of the Indian Penal Code.

Vide order dated 15-2-2021, interim pre-arrest protection was granted and the applicant was directed to attend the concerned police station on 19th and 20th February, 2021. The applicant has complied with the condition.

Considering the nature of the allegations, custodial interrogation is not necessary. The submission of the learned counsel that the allegations stem from marital discord, cannot be brushed under the carpet. Certain allegations, particularly the allegation that the applicant was in a illicit relationship, pertains to the year 2006. Few allegations pertained to 2010. The most recent allegation in the report dated 23-9-2020 is that on 25-8-2020, the applicant and his parents picked up a quarrel with the complainant and dropped her at her parental house along with children.

Considering the nature of the allegations and the material in the case diary, the interim pre-arrest protection granted vide order dated 15-2-2021 is made absolute subject to modification that till filing of the charge-sheet, the applicant shall attend the concerned police station as and when directed by the Investigating Officer.
