First Appeal No.479 of 2011 was dismissed on merit on 13/07/2012. It is prayed by the respondents in the said appeal that the balance amount of compensation with accrued interest be permitted to be withdrawn.

By the judgment of the Railway Claims Tribunal, Nagpur, it directed the appellant to pay Rs.1,50,000/- each to the respondent Nos.1 and 2. Out of the said amount, Rs.50,000/- was to be paid by crossed cheque to the respondent No.3-the guardian and the remaining amount of Rs.1,00,000/- each was to be invested in fixed deposit till respondent Nos.1 and 2 attain the age of majority. A further amount of Rs.1,00,000/- was to be paid to respondent No.3 out of which, Rs.,50,000/- was paid by cheque and remaining Rs.50,000/- was invested for a period of three years. As the appeal has been

caf.833.16 2/2 dismissed, the respondent Nos.1 and 3 would be entitled to withdraw the amount deposited with accrued interest. Similarly, the amounts deposited in favour of respondent No.2 shall be released with accrued interest when he attains majority. The civil application is allowed in aforesaid terms and disposed of.
