Mr. Joshi, the learned counsel for the applicant states that the crime number is incorrectly mentioned as 16/2021. The Crime number is 03/2021.

Leave to correct the application appropriately. 3.
The applicant, who is apprehending arrest in Crime 03/2021 registered with Police Station Janefal, Tahsil Mehkar, District Buldhana for offences punishable under Section 380 read with Section 34 of the Indian Penal Code suffers from 100% visual disability, as is reflected from the disability certificate.

While the prosecution has produced the case diary, there is no rebuttal to the assertion that the applicant is totally blind.

The co-accused is arrested and released on regular bail.

The applicant has attended the police station as directed.

Considering the disability, and the fact that the applicant is co-operating with the Investigating Officer, custodial interrogation is not necessary.

The interim protection granted vide order dated 16.02.2021 is made absolute with the only modification that the applicant shall attend the concerned police station as and when directed, till the filing of the charge-sheet. JUDGE NSN
