Shri T.A.Mirza, learned A.P.P. for the nonapplicant states that the earlier order passed by the Sessions Court rejecting the application was challenged before this Court and as the application filed by the applicant was dismissed by this Court, the applicant had moved the Hon'ble Supreme Court in the matter. The applicant has suppressed these facts in the application.

In view of the above, Shri R.R. Vyas, learned advocate for the applicant seeks permission to withdraw this application with liberty to file fresh application. The application is disposed of as withdrawn with liberty as prayed for.
