Heard Shri Bhate, the learned counsel for the petitioner and Shri Bhutada, the learned counsel for the respondent.
2] The following order is passed with consent.
3] The petitioner shall deposit amount of Rs.1,00,000/- in the trial court within seven days. 4] On deposit of the said amount, the trial court shall permit the handwriting expert Ms. Deepti Andharmule to inspect the record and to take the necessary photographs as would enable her to give the expert opinion which the petitioner - accused is desirous of having on record. The handwriting expert shall be considered as the witness of the petitioner - accused.
cwp128.20.O.odt 5] The handwriting expert shall do the needful and submit the report in the Court within a fifteen days from the deposit of the amount of Rs.1,00,000/- by the petitioner - accused.
6] The trial court shall complete the trial and pronounce the judgment within the next thirty days from the receipt of the report of the handwriting expert. 7] No adjournment shall be granted for whatsoever reason and the trial shall be conducted on a day-to-day basis, after the receipt of the report from the handwriting expert.
8] The petition is disposed of in the light of the afore-recorded consent terms.
