Though some necessary details are lacking in the application, considering the facts of the case and the fact that the non-applicants are not opposing the application inasmuch as the reply is not filed, the delay in filing the appeal is condoned. The application is allowed. The applicant shall pay costs of Rs.1,000/- to the learned Advocate for the non-applicant Nos.1 to 3 and produce the receipt on record till 13-2-2015, failing which this order shall stand recalled and the civil application and appeal shall stand dismissed without reference to the Court.
