The applicant is sentenced to suffer rigorous imprisonment of 7 years for offence punishable under Section 307 of the Indian Penal Code.

However, record reveals that the appellantaccused has already put in more than 5 years and 4 months of detention.

Criminal Application No. 106/2018 is allowed. 4.

The sentence is suspended till the disposal of the appeal. The accused be released on bail.

Bail is in trial court.
