DATED : NOVEMBER 30 , 2021 This appeal is pending for final hearing from 2008. The record shows that the counsel for the appellant Maharashtra State Road Transport Corporation has not appeared since last four dates right from 03.01.2020. Even at no point of time, any Advocate has appeared to make a request for adjournment.

It shows that the appellant and the counsel for the appellant have lost interest in prosecuting this appeal. The appeal is against grant of compensation, granted in favour of the respondent nos.1 to 4 on account of death of one Sanjay and also injuries caused to Smt. Pratibha respondent no.1. Hence, the appeal is dismissed for want of prosecution.

The respondents are permitted to withdraw the amount deposited by the appellant along with interest accrued thereon as per the apportionment made by the learned Member, M.A.C.T. Akola.
