The applicant is apprehending arrest in Crime 1342/2020 registered with Police Station Mangrulpir, District Washim for offences punishable under Sections 188, 272, 273 and 328 of the Indian Penal Code and Section 59 of Food Safety and Standards Act, 2006.

It is not in dispute that the alleged prohibited articles are already seized. As a condition of interim pre-arrest protection, the applicant has attended the concerned police station on 21st and 22nd February, 2021. It does not appear that custodial interrogation is necessary. 3.

Considering that the applicant has no adverse antecedents, and the implication in the crime appears to be his first brush with law, he can be protected, particularly since the investigation is not likely to be affected.

The interim pre-arrest protection granted vide order dated 16.02.2021 is made absolute with the only modification that the applicant shall attend the concerned police station as and when directed, till the filing of the charge-sheet.
