DATED: February 16, 2017 The claimants seek permission to withdraw the amount of compensation deposited by the appellant. The application is opposed by learned counsel for the appellant on the ground that the Claims Tribunal was not justified in awarding the compensation of Rs. 3,24,000/-. Perused the judgment of the Reference Court. In the facts of the case, the claimants are permitted to withdraw the amount of Rs. 2,00,000/- on filing the undertaking that in case the appeal is allowed, the said amount shall be repaid with interest at such rate the Court may direct. Remaining amount be invested in the Fixed Deposit. Civil Application is disposed of.
