IN THE HIGH COURT OF JUDICATURE AT BOMBAY
NAGPUR BENCH : NAGPUR.
Criminal Writ Petition No.127/2016 (Sergeant Sujitkumar Umacharan Sahu .vs. State of Maharashtra and others. ) ------------------------------------------------------------------------------------------------- Office Notes, Office Memoranda of Coram, appearances, Court's orders or directions Court's or Judge's orders.
and Registrar's orders Mr. S.G. Malode, Advocate for Petitioner.
Mr. V.A. Thakre, APP for Respondent Nos. 1 to 3. ...
CORAM : B.R. Gavai & V.M. Deshpande, JJ.
DATED : July 04,2016.
The petition is filed praying for transfer of investigation to some other agency. It is the contention of the petitioner that the investigation is not carried out by respondent no.4 in a proper manner.
The affidavit has been filed by one Shri D.P. Patil, who is presently working as Police Inspector, Ranapratapnagar Police Station, Nagpur. The perusal of the affidavit would reveal that all necessary steps for proper investigation has been taken by the investigating agency.
Merely because the person feel that the outcome of the investigation should be as per his own choice, cannot be a ground to say that the investigation is not carried out in a fair manner.
In that view of the matter, we do not find that the case is made out for interference. Writ petition is rejected.
