DATE : FEBRUARY 03 , 2016.
By this petition, the petitioners seek a direction to the respondent no.1-Maharashtra State Board of Secondary and Higher Secondary Education, Nagpur to accept the examination form of the petitioners for Summer-2015 examination, without late fees. This Court had, by an order dated 16.02.2015, issued notice to the respondents, however, no interim relief was granted in favour of the petitioners.
Shri Parchure, the learned counsel for the respondent no.1, states that the cause for filing the writ petition is rendered infructuous as the only prayer made by the petitioners was for a direction to the respondent no.1 to permit the petitioners at the Summer-2015 examination, without late fees. It is submitted that the Summer-2015 examinations are conducted and thereafter, the Winter-2015 examinations are also conducted.
We find much force in the submission made on behalf of the respondent no.1. Hence, we dispose of the writ petition with no order as to costs.
