DATE : 10.3.2016 Heard Shri Mir Nagman Ali, advocate for the applicant and Shri N.S. Khubalkar, A.P.P. for the non-applicant. The applicant is arrested in crime registered against 10 persons (including the applicant) for the offence punishable under Section 307, 302, 147, 148, 149 of the Indian penal Code and under Section 3/25 of the Indian Arms Act.
The application is opposed by the learned A.P.P. on the ground that the victim has named the applicant and the name of applicant is in the F.I.R., that there is ample material against the applicant and that he is a history-sheeter. The learned A.P.P. has pointed out the chart
2 ba89.16 showing the number of crimes registered against the applicant. Considering the nature of incident, nature of accusations against the applicant, I am not inclined to show indulgence at this stage. The application is rejected with liberty to the applicant to move fresh application after three months, if so advised. JUDGE Tambaskar.
