For the reasons stated in the application and as I find the same satisfactory and explaining the delay properly, I am of the opinion that the delay should be condoned.

Though, the learned AGP for respondent No.2/State opposes the application and none appears for the respondent No.1 despite service, the application is allowed. The delay caused in filing second appeal, is condoned. The appeal be registered.

The application is disposed of accordingly.
