DATED : 26/02/2021 Learned counsel for the petitioner, on instructions, seeks leave of the Court to withdraw the petition with liberty to resort to an alternate remedy of an appeal as provided under Rule 2 (3) of the Prisons (Bombay Furlough and Parole) Rules, 1959 with issuance of necessary directions in the matter.

Leave with liberty as prayed for is granted.

The petitioner is granted liberty to file an appeal before appropriate authority within two weeks from the date of the order and, if any such appeal is filed, it shall be entertained and decided on merits of the matter by condoning delay, if any, and the final decision shall be rendered in accordance with law within four weeks from the date of appeal.
