Perused the records, which indicate that the appellants as well as respondent no.1 were elected as Members of the Gram Panchayat, Khursapur, Tahsil Katol, District Nagpur in the year 2011. Respondent no.1 was elected as Chairman and it is the case of the appellants that on 15.7.2011, respondent no.1 had tendered her resignation.

The resignation came to be accepted on 19.7.2011, which however disputed by respondent no.1 by filing proceedings under Section 29 (3) of the Maharashtra Village Panchayat Act, 1958. The Collector allowed that application and restored respondent no.1 on the post of Sarpanch. The writ petition preferred by the present appellants challenging that order was
lpa163.12 2/2 dismissed on 2.2.2012. Hence, this Letters Patent Appeal. 4.
It is clear from the record that the effective term of the appellants as well as respondent no.1 has come to the end with the passage of time.

In view thereof, the challenge raised in the present proceedings is rendered infructuous. Letters Patent Appeal is, therefore, dismissed. No costs.
