DATED : 31-08-2016 The learned Advocates for the appellant and respondent No.1 have filed joint pursis dated 10-08-2016 and alongwith it copy of communication sent by the Chief Engineer, Bembla Project on 10-08-2016 to the Advocate representing the appellant is annexed. Relying on the above communication, it is stated that the appellant has accepted the offer given by the claimant to settle the claim at the rate of Rs.750/- per square meter. In view of the above, the impugned award is modified holding that the claimant is entitled for the compensation at the rate of Rs.750/- per square meter alongwith statutory benefits.

The appeal is disposed in the above terms. In the circumstances, the parties to bear their own costs.
