The reply affidavit is filed on behalf of State on 10 March 2022 wherein following averment is made:-

The respondent no.3 while passing an order dated 04.01.2022 has erred in reading of the order of this Hon'ble Court and tenders its unconditional apology for the same. The respondent no.3 seeks leave of this Hon'ble Court to recall the order dated 04.01.2022. The respondent no.3 would conduct fresh inquiry for allotment of plot to the respondent no.5 and also grant opportunity of hearing to the petitioner before any order is passed in this behalf."

The learned Counsel for the Petitioner states that the Petitioner is satisfied with the stand taken and in light of the same, Petitioner does not intend to pursue the petition further. Accordingly writ petition is disposed of.

We make it clear that we have disposed of writ petition in view of the above circumstances and have not entered into the merits of the controversy which is kept open in case any issue arises in future.
