Heard Mr. Sambre, learned counsel for the applicants. After hearing the matter for some time on merits, when the Court was not inclined to accept the application, Mr. Sambre, learned counsel for the applicant, upon instruction seeks to withdraw the application with liberty to approach the Court after six months, in case the trial is not commenced, as the applicant No. 1 who is the wife of deceased, has two sons, one of whom is with her parents and other is with the parents of the deceased and considering the age of the parents, who are claimed to be not in a position to look after the children. Statement is accepted. 2.

The application is dismissed as withdrawn with liberty as prayed for.
